1. About these Terms

This website is operated by BrickFans. Throughout this website, the terms “we”, “us”, and “our” refer to BrickFans.

By using our website or placing an order, you agree to these Terms. These Terms should be read together with our Shipping Policy, Returns & Refunds Policy, and Privacy Policy.

2. Consumer rights

Nothing in these Terms limits or excludes any rights you may have under the **Consumer Guarantees Act 1993**, the **Fair Trading Act 1986**, or any other New Zealand law that cannot legally be excluded.

Our products are supplied with the consumer guarantees that apply under New Zealand law. Those rights apply in addition to any BrickFans warranty or voluntary change-of-mind returns policy.

3. Product information and compatibility

We take reasonable care to ensure product descriptions, dimensions, specifications, pricing, and images are accurate. Colours may vary slightly between screens and actual products.

Many BrickFans products are designed to be compatible with selected LEGO® sets. Unless a product page expressly states otherwise, BrickFans products are accessory products only. LEGO® sets, minifigures, and other display items shown in product images or videos are not included.

LEGO® is a trademark of the LEGO Group of companies. The LEGO Group does not sponsor, authorise, or endorse BrickFans or this website.

4. Orders and availability

Placing an order is an offer to purchase the selected products. An order is accepted when we send you an order-confirmation or dispatch-confirmation email, subject to product availability and payment approval.

We may need to decline or cancel an order before dispatch where a product is unavailable, a genuine pricing or listing error has occurred, payment cannot be authorised, or we reasonably suspect fraud. If we cancel an order after payment has been taken, we will notify you and provide a full refund of the amount paid for the cancelled item.

Some products may be offered on a pre-order basis. Any estimated arrival or dispatch date is an estimate only. We will contact you if there is a material change to the estimated timeframe.

5. Prices and payment

All prices are shown in New Zealand dollars (NZD) and include GST unless stated otherwise. Shipping charges are calculated and shown at checkout before you complete payment.

We may update prices, promotions, and product availability from time to time. Changes do not affect orders that we have already accepted, except where a genuine pricing error is identified before dispatch.

Payment must be received or authorised before we dispatch an order.

6. Delivery

Delivery information, estimated timeframes, shipping charges, and our process for delivery issues are set out in our Shipping Policy. Delivery estimates begin after dispatch and are not guaranteed delivery dates.

If goods are not delivered within the agreed timeframe or, where no timeframe is agreed, within a reasonable time, please contact us. Your rights under New Zealand consumer law are not affected.

7. Returns, refunds, repairs, and replacements

Our Returns & Refunds Policy explains our voluntary change-of-mind return policy and the process for faulty, damaged, or incorrect goods.

If goods do not meet the guarantees under the Consumer Guarantees Act 1993, you may be entitled to a repair, replacement, refund, or other remedy depending on the nature of the issue. We will assess each claim in accordance with New Zealand law.

8. Product use and safety

Please read and follow all product instructions and safety information before use. Our light kits contain small components and may contain batteries or electrical components. They are not intended for children under 6 years old and should be used with adult supervision where appropriate.

Use light kits only with the specified power source and in accordance with the relevant installation instructions. Do not modify electrical components or use damaged cables, connectors, batteries, or power supplies.

9. Website use and intellectual property

All content on this website, including BrickFans branding, text, images, videos, product designs, and downloadable materials, is owned by or licensed to BrickFans unless stated otherwise. You may not copy, reproduce, distribute, or use this content for commercial purposes without our written permission.

You must not misuse the website, interfere with its security, upload malicious code, scrape content, or use the website for an unlawful purpose.

10. Third-party services and links

Our website may contain links to third-party websites or services. We are not responsible for the content, availability, privacy practices, or terms of third-party websites. Your use of those sites is governed by their own terms and policies.

11. Privacy

Our collection, use, storage, and disclosure of personal information is explained in our Privacy Policy.

12. Liability

To the fullest extent permitted by law, BrickFans is not liable for indirect or consequential loss that was not reasonably foreseeable. This does not limit any liability or consumer right that cannot legally be excluded, including rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.

13. Changes to these Terms

We may update these Terms from time to time by publishing the revised version on this page and updating the “Last updated” date. The version in force when we accept your order applies to that order, unless a change is required by law or agreed with you.

14. New Zealand law

These Terms are governed by the laws of New Zealand. Any dispute will be dealt with under New Zealand law.
